Terms of Service

These Terms of Service ("Terms") govern the relationship between Familjen Yahya AB ("ViTech Cloud", "we", "us") and the customer ("you", "customer") regarding ViTech Cloud's services. By using our services you accept these Terms.
Parties
Provider: Familjen Yahya AB, org. no. 559296-5148, Stockholm, Sweden.
Customer: The company or individual that has entered into agreement with ViTech Cloud.
Services
ViTech Cloud provides managed IT services, cloud solutions and SaaS platforms according to the specific service description agreed upon. We reserve the right to update and improve services with reasonable notice.
Accounts and Responsibility
The customer is responsible for:
- Keeping login credentials secure and confidential
- Immediately notifying ViTech Cloud of unauthorized access
- Ensuring all users comply with these Terms
- Using services in accordance with applicable laws and regulations
Payment and Invoicing
- Services are invoiced monthly in advance (or annually for annual agreements)
- Payment terms: 10 days from invoice date
- For late payment, ViTech Cloud is entitled to apply late payment interest under Swedish law
- All prices are in SEK excluding VAT (25% for Swedish customers)
- Price changes are notified with at least 30 days notice
Acceptable Use
It is prohibited to use ViTech Cloud's services to:
- Distribute malicious code, viruses or other harmful software
- Send unsolicited email (spam)
- Store or distribute illegal content
- Attempt unauthorized access to systems
- Violate applicable laws and regulations
- Harm ViTech Cloud or others' interests
Service Level Agreement (SLA)
ViTech Cloud guarantees 99.9% uptime for production services. Planned maintenance is communicated with at least 48 hours notice and does not count as downtime. In case of SLA breach, the customer receives credits:
- 99.0% β 99.9%: 10% of monthly fee
- 95.0% β 99.0%: 25% of monthly fee
- Below 95.0%: 50% of monthly fee
Limitation of Liability
ViTech Cloud's total liability to the customer is limited to the amount the customer has paid during the last 3 months. We are not liable for indirect damage, lost profits or data loss due to circumstances beyond our control.
Termination
The customer may terminate the agreement with 30 days written notice. ViTech Cloud may terminate the agreement immediately for material breach, non-payment after reminder, or if the customer is declared bankrupt. Upon termination, ViTech Cloud retains the customer's data for 30 days for possible export.
Governing Law and Dispute Resolution
These Terms are governed by Swedish law. Disputes shall primarily be resolved by negotiation, secondarily at the Stockholm District Court.
